These Terms of Service ("Terms") are an agreement between you and Emadex Creations, the business that operates PostWaka ("PostWaka", "we", "us"). By creating an account, joining the waitlist or using PostWaka, you agree to these Terms and to our Privacy Policy.
1. What PostWaka does
PostWaka lets you connect your social media accounts and publish or schedule posts to them from one place, including Facebook Pages, Instagram, Threads, TikTok and YouTube. Some features depend on the platforms' own services, which can change.
2. Who can use PostWaka
You must be at least 13 years old. If you are under 18, you need the permission of a parent or guardian. If you use PostWaka for a business, you confirm that you are allowed to accept these Terms for it.
3. Your account
Keep your login details safe and tell us straight away if you think someone has used your account. You are responsible for what happens in your account.
4. Connected platforms
When you connect an account, you authorise PostWaka to publish the content you choose to that account. You must follow the rules of each platform, including the Meta Terms, Instagram Terms of Use, TikTok Terms of Service and YouTube Terms of Service. Platforms may limit, reject or remove posts, or change how their services work; we are not responsible for their decisions. You can disconnect an account at any time.
If you boost posts as ads, the ads run on your own Meta ad account: Meta charges you directly with the payment method in that ad account, and Meta's Advertising Standards apply. Meta reviews every ad and may reject or stop it. PostWaka does not take or hold ad money and is not responsible for Meta's charges, reviews or results.
5. Your content
You keep ownership of everything you upload or write. You give PostWaka permission to store, process, resize and publish your content only as needed to provide the service you ask for. You confirm that you have the rights to everything you post, and that it does not break any law or anyone else's rights. This includes music: a song used without its rights owner's permission can get your post muted, blocked or removed by the platform, even when you are paid to promote it. Music from the PostWaka library may be used as its licence says; music you upload must be yours or used with permission.
6. Things you must not do
- Post anything illegal, hateful, violent, sexually explicit involving minors, or that harasses anyone.
- Post content you don't have the rights to, or pretend to be someone else.
- Send spam or use PostWaka to manipulate likes, followers or views.
- Try to break, overload or get around the security of PostWaka or the connected platforms.
- Resell PostWaka without our written permission.
We may remove content or suspend accounts that break these rules.
7. Plans and payments
- Every plan starts with a 7-day free trial. No card is needed for the trial.
- When the trial ends, choose a plan to keep using PostWaka. If you don't, your account is paused and your scheduled posts are not published until you choose a plan.
- Each plan has the limits shown on our pricing section.
- Plans are charged through Paystack in naira (or, outside Nigeria, in the currency shown to you when you pay) (card, bank transfer or USSD), weekly, monthly or yearly. If you pay by card, your plan renews automatically the day before each period ends until you turn this off in Billing; we email a receipt each time. If you pay another way, we email you 2 days before your plan ends so you can renew.
- You can cancel at any time by turning off automatic renewal in Billing; your plan stays active until the end of the period you paid for. Payments are not refunded for unused time, except where the law requires it.
- We may change prices. We will tell you at least 14 days before a new price applies to you. Founding Creators get the Creator plan free for 3 months from the day they are accepted, then 20% off every payment for the next 2 years; after that, normal prices apply. Price changes do not reduce a Founding Creator's discount.
8. Availability
We work hard to keep PostWaka running, but we cannot promise it will always be available or that every post will be published at the exact time scheduled, especially when a platform is down or changes its rules. Always keep your own copies of your content.
9. Ending your account
You can delete your account at any time (see Data Deletion). We may suspend or close accounts that break these Terms, put other users at risk or are required to be closed by law.
10. Limits of our responsibility
PostWaka is provided "as is". To the extent the law allows, we are not responsible for indirect losses such as lost income, followers or opportunities, and our total responsibility to you is limited to the amount you paid us in the 3 months before the claim. Nothing in these Terms limits rights you have under Nigerian consumer law that cannot be limited.
11. Changes to these Terms
We may update these Terms. We will tell you about important changes by email or in the app before they apply. If you keep using PostWaka after that, you accept the new Terms.
12. Law
These Terms are governed by the laws of the Federal Republic of Nigeria.
